In another interesting twist to the Greg McMackin “Retirement” agreement, both the University of Hawaii and former UH football head coach Greg McMackin have agreed not to speak despairingly of one another, or in other words, both sides have agreed not to talk trash.
The “non-disparagement” clause is part of a seven-page “mutual settlement and release agreement” effective Dec. 5. You can obtain these records under the state’s open records law.
Under the settlement, UH agrees to pay McMackin $600,000 on Jan. 5, 2012, terminating an original five-year deal paying $1.1 million per year that had been contracted to run to Jan. 15, 2013. The agreement purports that “…after concerted discussions, the parties now voluntarily and mutually agree to terminate the employment agreement…”
Under terms of the settlement, McMackin releases UH from all “past, present and future claims” including the Age Discrimination in Employment Act unless rescinded by Dec. 26, 2011.
The agreement says “McMackin’s only obligations shall be to remain accessible and provide (the) university his fullest cooperation with respect to any issues that may arise from, relate to or involve matters occurring during McMackin’s employment as head coach …”
This is interesting, not very often do you have something like this written into a clause. This just goes to show how bad things had apparently gotten within the Hawaii football program. If both parties have to agree not to talk trash about each other, then you know there must have been some pretty harsh things being said behind the scenes.
Either way, this effectively closes the door on McMackin – at least I think so, who had a pretty rough go of it at UH before “retiring/resigning” as head football coach from the University of Hawaii.
